Terms of Use – Aussie Petrol

1. Who we are

Aussie Petrol is a mobile application and related digital platform (Platform) operated by Belivio Pty Ltd (ABN: 25 685 277 374) (we, us, our).

2. Acceptance of these terms

By using our Platform, you confirm that you accept these Terms of Use and agree to comply with them. If you do not agree to these terms, you must not use the Platform.

3. Changes to these terms

We may update these Terms of Use from time to time. The latest version will always apply when you use the Platform. By continuing to use the Platform after changes are made, you are taken to have accepted the updated terms.

4. Changes to the Platform

We may update, modify, or discontinue parts of the Platform at any time to reflect changes to features, user needs, legal requirements, or business priorities. We will try to provide reasonable notice of any major changes where practicable.

5. Availability of the Platform

We do not guarantee that the Platform will always be available, uninterrupted, or error-free. We may suspend, withdraw, or restrict access to all or part of the Platform for operational or business reasons.

Any references to "lifetime access" mean access for as long as the Platform is made available by us.

6. Eligibility and geographic use

The Platform is intended for users located in Australia. We do not represent that content or services are appropriate or available for use outside Australia. If you access the Platform from outside Australia, you do so at your own risk and are responsible for complying with applicable local laws.

7. Account security

If you create an account or are provided with login credentials, you must keep them confidential and not share them with any third party. You are responsible for all activity that occurs under your account.

We may suspend or disable your account if we reasonably believe you have breached these terms. If you believe your account has been compromised, you must notify us promptly.

8. Intellectual property and permitted use

We own or license all intellectual property rights in the Platform and its content, including text, graphics, logos, software, and underlying technology. These works are protected by copyright and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own personal, non-commercial purposes.

This licence does not transfer ownership of the Platform or any intellectual property rights to you. Except for the limited rights expressly granted, no rights, title, or interest in the Platform are assigned or transferred to you.

You must not reproduce, distribute, modify, create derivative works from, publicly display, exploit, or otherwise use any part of the Platform for commercial purposes without our prior written consent.

You must not remove or alter any copyright, trademark, or other proprietary notices.

9. Information accuracy and disclaimers

The Platform and its content are provided on an "as is" and "as available" basis. The information provided is for general information purposes only and does not constitute advice.

While we make reasonable efforts to keep information up to date, we do not guarantee that any content is accurate, complete, or current. Fuel prices, discounts, and related data may be delayed, estimated, incomplete, or subject to change.

9A. Fuel price data sources and calculations

The Platform displays fuel pricing information sourced from a combination of official government fuel price data, publicly available information, and third-party sources.

For clarity:

"Base price" refers to the underlying fuel price obtained from official government fuel price schemes or other authoritative sources, before any adjustments, estimates, discounts, or loyalty benefits are applied.
Government fuel price data may be subject to reporting delays, update frequency limitations, geographic constraints, regulatory conditions imposed by the relevant authority, and technical or operational delays in retrieval, processing, or display within the Platform.

Some official fuel price schemes may apply mandatory publication delays (for example, up to 24 hours) between a price being reported and it being made publicly available. Where such delays apply, prices displayed in the Platform may not reflect the most recent pump price.

The specific source of base price data applicable to a fuel station or location is displayed within the Platform user interface, including in the station information or station detail views.

The Platform may display calculated or estimated prices by applying indicative discounts, loyalty benefits, or rewards information to the base price for comparison purposes only.

We do not guarantee that:

Any displayed base price reflects the current pump price at a specific fuel station
Any calculated or adjusted price will be available to you
Any discount, loyalty benefit, or reward will be honoured by a fuel retailer

You must verify all prices, discounts, and eligibility directly with the relevant fuel retailer or official data source before purchase. Belivio Pty Ltd accepts no responsibility or liability for discrepancies between displayed prices and actual prices charged.

10. Third-party links and services

The Platform may contain links to third-party websites, services, or resources. These are provided for convenience only. We have no control over third-party content and accept no responsibility for it. Accessing third-party services is at your own risk and subject to their terms.

11. Price issues, corrections, and user feedback

The Platform may allow users to submit feedback or reports relating to displayed fuel prices, discounts, or other information.

Where fuel price data is sourced from official government fuel price schemes or third-party providers, price accuracy, corrections, and enforcement are governed by those external sources.

If you believe a fuel price displayed in the Platform is incorrect or misleading, you may be required to report the issue directly to the relevant government scheme, fuel retailer, or data provider in accordance with their processes.

Any feedback submitted through the Platform is used solely to help us improve the presentation or handling of information and does not constitute an official report to, or correction request with, any government authority or fuel retailer.

We do not guarantee that feedback submissions will result in corrections, updates, or action by third parties.

11A. User-generated content

The Platform may allow users to submit feedback, reports, or other content (User Content).

You retain ownership of any intellectual property rights you hold in your User Content. By submitting User Content, you grant Belivio Pty Ltd a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, modify, adapt, publish, display, store, analyse, and otherwise use that User Content for the purpose of operating, improving, analysing, and promoting the Platform.

You acknowledge and agree that User Content may be submitted without identifying information and that we may not be able to identify, associate, retrieve, access, or delete User Content by reference to you or your account.

Accordingly, once User Content is submitted, you acknowledge that you may not have the ability to access, retrieve, copy, delete, or require the return of that User Content, except where required by applicable law.

You acknowledge and agree that you are not entitled to any compensation for our use of User Content and that you waive, to the extent permitted by law, any moral rights or similar rights in relation to that use.

You represent and warrant that:

You own or have the right to submit the User Content
The User Content complies with these terms and applicable laws

We may remove or refuse to publish User Content at our discretion. We are not responsible for User Content submitted by you or other users.

12. Content standards

User Content must not:

Be unlawful, misleading, defamatory, obscene, or offensive
Infringe intellectual property or privacy rights
Promote illegal activities, scams, or harmful conduct
Impersonate another person or entity
Contain unauthorised advertising or spam

You are responsible for any loss or damage resulting from your breach of these content standards.

13. Limitation of liability

To the fullest extent permitted by law, you acknowledge and agree that you use the Platform at your own risk.

We do not warrant and do not accept responsibility for the accuracy, completeness, timeliness, or reliability of any information presented in the Platform, including fuel prices, base prices, discounts, loyalty benefits, or rewards information.

You agree that Belivio Pty Ltd is not liable for any loss, damage, cost, or expense arising from your use of, or reliance on, information displayed in the Platform, including where such information is incorrect, incomplete, delayed, or outdated.

Without limitation, we are not responsible for:

Any discrepancies between displayed information and actual prices, discounts, or benefits offered by fuel retailers
Any decisions you make, or actions you take or refrain from taking, based on information displayed in the Platform
Any losses arising from third-party brands, loyalty programs, rewards schemes, or government data sources

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights that cannot be excluded under the Australian Consumer Law. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

To the extent permitted by law, you are responsible for any loss or damage caused by your misuse of the Platform or breach of these Terms.

You agree to indemnify us against any claims, losses, damages, or expenses arising from your breach of these terms, misuse of the Platform, or reliance on information displayed in the Platform.

14. Viruses and security

We do not guarantee that the Platform will be secure or free from bugs or viruses. You are responsible for using appropriate security and virus protection measures on your device.

15. Linking to the Platform

You may link to the Platform in a fair and lawful manner that does not damage our reputation or suggest endorsement. We may withdraw linking permission at any time without notice.

16. Governing law and jurisdiction

These Terms of Use are governed by the laws of New South Wales, Australia.

You and we irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia, in respect of any dispute, claim, or matter arising out of or in connection with these Terms or your use of the Platform.

17. Trademarks, third-party brands, and data sources

Aussie Petrol and all related names, logos, and branding are trademarks of Belivio Pty Ltd or its licensors.

The Platform may display trademarks, brand names, logos, fuel brand identifiers, loyalty or rewards program names, and references to government fuel price schemes or data sources that are owned or operated by third parties.

All third-party trademarks, brand names, logos, and data sources remain the property of their respective owners or operators.

Belivio Pty Ltd does not own, operate, control, endorse, sponsor, or have any official affiliation with any third-party fuel retailer, brand, loyalty or rewards program, or government body or data source, unless expressly stated.

References to third-party brands or government data sources are made solely for identification, comparison, and informational purposes.

18. Prohibited uses

You must not:

Use the Platform unlawfully or in breach of regulations
Attempt to gain unauthorised access to the Platform, its systems, servers, APIs, or data
Circumvent, bypass, disable, or interfere with any security, authentication, access control, rate-limiting, or technical protection measures
Introduce malicious code, malware, exploits, or otherwise interfere with the proper operation, security, or integrity of the Platform
Probe, scan, test, or attempt to compromise the Platform or its infrastructure without our prior written authorisation
Use automated systems, bots, scripts, scrapers, or similar means to access, extract, or copy data or content from the Platform
Misuse the Platform in a way that harms users, third parties, or the business
Reverse engineer, decompile, disassemble, modify, translate, adapt, or attempt to derive the source code, underlying ideas, algorithms, structure, or organisation of the Platform or any part of it, except to the extent such restriction is prohibited by applicable law

We may report unlawful activity to authorities and suspend or terminate your access immediately if you breach these terms.

19. Brand discounts, loyalty programs, and third-party information disclaimer

The Platform may display fuel price adjustments, estimated discounts, loyalty benefits, or potential rewards information associated with third-party fuel brands, retailers, or rewards programs.

This information is provided for general informational purposes only. We do not guarantee the accuracy, availability, eligibility, or applicability of any discount, loyalty benefit, or rewards program.

Terms, conditions, eligibility rules, and benefits of discounts and loyalty programs are determined solely by the relevant third-party providers and may change at any time without notice.

You are solely responsible for verifying all discount and loyalty information directly with the relevant brand or provider and for complying with their terms and conditions. Belivio Pty Ltd accepts no responsibility or liability for any loss, dispute, or issue arising from participation in third-party programs.

20. Subscriptions, payments, and ad removal

The Platform may offer optional subscriptions or one-time purchases that provide benefits such as the removal of advertisements or access to premium features.

All purchases and subscriptions are processed and managed by the relevant app store and third-party payment or subscription management providers. We do not store or process your full payment details.

Pricing, billing periods, auto-renewal terms, cancellations, refunds, and account eligibility are governed by the terms and policies of the applicable app store (such as the Apple App Store or Google Play Store) and the third-party subscription provider used.

Any requests for refunds, credits, or billing disputes must be made directly through the applicable app store in accordance with its refund policies. Belivio Pty Ltd does not have control over, and cannot guarantee, the outcome of any refund request.

We do not guarantee uninterrupted access to subscription benefits and reserve the right to modify, suspend, or discontinue subscription offerings or features in accordance with applicable laws.

21. Advertising and third-party services

The Platform may display advertisements served by third-party advertising partners and may integrate third-party analytics, attribution, or monetisation services.

These third parties may collect, use, and process certain device, usage, or advertising-related information in accordance with their own privacy policies.

We do not control how third-party advertising or service providers handle data. Your use of the Platform constitutes acknowledgment that such third parties may process information as described in our Privacy Policy.

22. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms of Use.
