Terms of Use for Inspire: Quotes

Welcome to Inspire: Quotes, a mobile application developed by Belivio Pty Ltd ("we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of the App. By using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License and Ownership

Inspire: Quotes is licensed, not sold. We grant you a limited, non-transferable, revocable license to use the App for your personal, non-commercial use, in accordance with these Terms.

All intellectual property, including source code, branding, features, curated content, music, themes, and designs, is owned by Belivio Pty Ltd and protected by copyright, trademark, and other applicable laws.

2. Platform-Specific Terms

a. iOS Users

Use of this App on Apple devices is subject to Apple’s Standard EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

b. Android Users

Use of this App on Android devices is governed by the Google Play Terms of Service: https://play.google.com/about/play-terms/

3. Subscriptions, In-App Purchases & Refunds

Some features of Inspire: Quotes require a subscription or a one-time purchase. All payments are securely processed through the Apple App Store or Google Play Store.

We do not provide refunds directly. All refund requests must be submitted to the appropriate platform:

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple or Google account settings.

4. Permissions and Data Collection

The App may request permission to access:

  • Notifications – to deliver daily inspirational reminders
  • Media Library – when enabling users to save or share content

Permission settings can be managed through your device settings.

5. Account Creation & Use

If the App allows account creation:

  • You must provide accurate and current information
  • You are responsible for maintaining the confidentiality of your login details
  • You agree not to impersonate others or use inappropriate usernames

We may suspend or terminate your account for violating these Terms.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or tamper with the App
  • Upload or share unlawful, harmful, or infringing content
  • Misuse sharing features for harassment or spam
  • Violate any applicable laws or regulations

We reserve the right to remove content or restrict access at our sole discretion.

7. User-Generated Content

If you create, upload, or submit any content within the App (including quotes, text, or other materials), you acknowledge and agree that:

  • You grant Belivio Pty Ltd a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, reproduce, modify, display, distribute, and create derivative works from your content for any purpose, including within the App and related services.
  • You understand that you retain no ownership, rights, or claims over any content created in or submitted through the App.
  • You agree that you will not request data export, deletion, or retrieval of content you create within the App.
  • You represent that the content you submit does not infringe on third-party rights.

We may remove or modify any user-generated content at our sole discretion.

8. No Data Portability or Export Rights

You acknowledge and agree that:

  • The App does not provide any right or ability for users to download, export, retrieve, or transfer any data or content created within the App.
  • You understand that all content created inside the App is fully controlled by Belivio Pty Ltd and may not be accessed, extracted, or transferred outside the App.
  • You waive any rights related to data portability or archival of user-generated content.

9. Intellectual Property and Feedback

All content and intellectual property in the App belongs to Belivio Pty Ltd.

If you submit suggestions or feedback, you grant us a worldwide, royalty-free license to use, implement, or modify such feedback without restriction.

10. Termination

We may suspend or terminate your access to the App at any time, without notice, for any violation of these Terms.

You may stop using the App at any time.

11. Disclaimers

To the fullest extent permitted by law, you acknowledge and agree that:

  • Your use of the App is entirely at your own risk.
  • We are not responsible or liable for any outcomes, decisions, reactions, interpretations, or consequences arising from your use of the App or its content.
  • The App provides general inspirational material only. It is not intended to guide personal, emotional, or wellbeing-related decisions, and must not be relied upon for any such purpose.
  • You agree that you will not assert any claim that the App, its content, notifications, or features influenced, impacted, or contributed to any personal or situational outcomes.
  • You understand that the App is for casual, general-use inspiration only and is not a substitute for personal judgement or professional guidance of any kind.
  • We do not guarantee the accuracy, completeness, or reliability of any content, including user-generated content.

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

  • The accuracy, completeness, or reliability of quotes or content
  • That the App will be error-free or uninterrupted
  • That defects will be corrected

Use the App at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Belivio Pty Ltd is not liable for any indirect, incidental, consequential, punitive, exemplary, or special damages (including, without limitation, loss of profits, loss of data, business interruption, reputational harm, or other intangible losses) arising from or related to your use of, or inability to use, the App.

Where liability cannot be fully excluded under applicable law, our liability will be limited to the fullest extent permitted by law.

In all cases, our total aggregate liability for any claim arising out of or in connection with the App shall not exceed the amount you paid for your most recent active subscription, if any. If you have not made a purchase, our liability is limited to AUD $0.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of courts located in NSW for any disputes.

14. No Class Actions & Limitation Period

You agree that:

  • You may only bring claims against Belivio Pty Ltd in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.
  • Any claim arising from or related to your use of the App must be brought within 12 months of the date the claim arose, or it is permanently barred, to the maximum extent permitted by law.

15. Export Compliance

You represent that you are not located in a country that is subject to embargo, sanctions, or other trade restrictions imposed by the Australian or U.S. governments, and that you are not on any government list of restricted or denied parties.

You agree not to use, export, re-export, or transfer the App in violation of any applicable export control or sanctions laws.

16. Consumer Rights (International Users)

Nothing in these Terms grants users any rights beyond those strictly required under the mandatory consumer protection laws of their jurisdiction. To the extent permitted by law, all non-mandatory rights are expressly excluded.

17. Changes to These Terms

We may revise these Terms at any time. Material updates will be communicated within the App or on our website. Your continued use of the App after such updates constitutes acceptance of the revised Terms.
