Terms of Use for Swipecard: Brain Trainer

Welcome to Swipecard: Brain Trainer, a mobile application developed by Belivio Pty Ltd (“we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of the App. By using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License and Ownership

Swipecard: Brain Trainer is licensed, not sold. We grant you a limited, non-transferable, revocable license to use the App for your personal, non-commercial use, in accordance with these Terms.

All intellectual property, including source code, branding, features, and content, is owned by Belivio Pty Ltd and protected by copyright, trademark, and other laws.

2. Platform-Specific Terms

a. iOS Users

Use of this App on Apple devices is subject to Apple’s Standard EULA:

b. Android Users

Use of this App on Android devices is governed by the Google Play Terms of Service:

3. Subscriptions, In-App Purchases & Refunds

All payments are securely processed through the Apple App Store or Google Play Store.
We do not provide refunds directly. All refund requests must be submitted to the appropriate platform:

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple or Google account settings.

4. Permissions and Data Collection

The App may request permission to access:

  • Camera and Photo Library – for adding flashcard content
  • Push Notifications – for study reminders
  • Analytics – anonymous usage data (optional and non-personally identifiable)

You can manage permissions via your device settings.
We do not collect personal information without your explicit consent.

5. User Accounts

If the App allows account creation:

  • You must provide accurate and current information
  • Keep your password secure and confidential
  • Accept responsibility for any activity under your account
  • Not impersonate others or use offensive usernames

We may suspend or terminate your account for violations of these Terms.

6. Acceptable Use

You agree not to:

  • Reverse-engineer or tamper with the App
  • Upload unlawful, abusive, or infringing content
  • Exploit, disrupt, or misuse any features
  • Violate any applicable laws or regulations

We reserve the right to remove any content or restrict your access at our sole discretion.

7. Intellectual Property and Feedback

All content and intellectual property in the App belongs to Belivio Pty Ltd.
By submitting feedback or suggestions, you grant us a worldwide, royalty-free license to use, modify, and implement such feedback without restriction.

8. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any violation of these Terms.
You may stop using the App at any time.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

  • Accuracy, completeness, or reliability of content
  • That the App will be uninterrupted or error-free
  • That defects will be corrected

Use the App at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Belivio Pty Ltd shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the App.

Our total liability shall not exceed the amount you paid for your most recent active subscription, if any.
If you have not made a purchase, our liability is limited to AUD $0.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
You agree to submit to the exclusive jurisdiction of courts located in NSW for any disputes.

12. Export Compliance

You represent that you are not located in a country that is embargoed by the Australian or U.S. governments and are not on any restricted or denied-party list.

13. Consumer Rights (International Users)

If you reside in a jurisdiction with specific consumer protection laws such as the EU or UK, you retain all mandatory rights granted to you under applicable law.

14. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the App or our website. Continued use of the App after any updates constitutes acceptance of the revised Terms.
